MEXINTEL, LLC., as a Background checks information retrieval service (hereinafter referred to collectively with the Site as “www.mexintel.com”), offers these services subject to your acceptance of these Terms and Conditions of Use.

These institutions are responsible for updating public information and ensuring its authenticity and accuracy.
Our algorithm automatically compiles this PUBLIC INFORMATION as stipulated in Section 18, Part II, second paragraph of the Transparency and Access to Mexican Governmental Public Information Act (Ley de Transparencia y Acceso a la Información Pública Gubernamental), which designates this data as public information, not classified as confidential, given its presence in Public Records or sources of public records access, such as judicial bulletins. MANDATORY ARBITRATION AND DISPUTE RESOLUTION

You also waive any rights under statutes or regulations that require an original signature, delivery, or retention of non-electronic records, or payments or credits through non-electronic means.
Mexintel.com services and wholesalers discounts are available only to individuals who are at least eighteen (18) years old and can enter into legally binding contracts under applicable law. If you are under eighteen (18) or do not agree with these Terms and Conditions in their entirety, do not access or use any page on the Site.
The Privacy Policy and Legal Framework are part of these Terms and Conditions and incorporated by reference. By accepting these Terms, you agree to the collection and use of your information by the Site as outlined in the Privacy Policy. Requests to remove information from Mexintel.com or public record results will be processed in accordance with the procedures outlined in the Privacy Policy.
Possible Modifications to These Terms and Conditions
MEXINTEL, LLC may modify these Terms and Conditions, in whole or in part, at any time and at its sole discretion, effective immediately upon posting the modified Terms and Conditions to the Site. If you are a wholesaler, any changes may be communicated directly when you log in to the Site. However, (I) any modification to the Dispute Resolution section will not apply to disputes initiated before the modification, and (II) any modification to the Fees and Billing section will not apply to charges incurred before the modification. If you do not terminate your Whosaler Services account (“Account”) within seven (7) days after receiving notice of these modifications or if you continue to use or access the Site or any whosaler services after the modified Terms and Conditions are posted, you agree to comply with and be bound by the changes. Unless explicitly stated otherwise, any future offers made available on the Site that enhance or augment the current features of the Site will also be subject to these Terms and Conditions.
If, before the effective date of these Terms and Conditions, you entered into a Wholesale Agreement with Mexintel.com governing your use of Discount Member Services, your continued use of these services will now be subject to these Terms and Conditions, which supersede the previous Membership Agreement, subject to the limitations described above.
RESTRICTIONS ON USE OF THE WEBSITE AND INFORMATION OBTAINED
Mexintel.com is a database of publicly available sources of information aggregated for your convenience. Through Mexintel.com, visitors to the Site (“Visitors”) can view or execute certain media, text, data, images, graphics, user interfaces, audio, video, photographs, trademarks, logos, artwork, designs, magnetic translations, digital conversions, software, and other materials posted to or made available through the Site (collectively, “Content”). This content is compiled, distributed, and displayed by Mexintel.com and third-party content providers (“Third-Party Providers”). These providers may include, but are not limited to, third-party websites or services that provide information about individuals or corporations from Mexican nationality or foreigners with legal records in Mexico (each, a “Search Subject”) accessible through the Site (“Mexintel.com Background Check Reports”). You are granted a non-exclusive, non-transferable, revocable, and limited license to access and use the Site, Content, and Mexintel.com Checks. Mexintel.com reserves the right to terminate this license at any time and for any reason.
DESCRIPTION OF SERVICE
MEXINTEL, LLC and “the Site” provide consumers and security businesses with access to public information from Mexico and other useful public data through its network of third-party information providers, including but not limited to Mexican courts countrywide, Mexican federal agencies, secretariats, international information providers, and other international federal and security organizations. The information provided includes, but is not limited to, criminal records, civil records, labor records, eviction records, warrants, money laundering, and bankruptcy records.
MEXINTEL, LLC and “the Site” operate as an online information solution, offering services as a legal court records retrieval agency in Mexico and other Latin American countries. Providing access to public information, and legal court records, in accordance with the “Ley Federal de Protección de Datos Personales en Posesión de los Particulares” (Federal Law for the Protection of Personal Data Held by Individuals in Mexico).
Emmobilien Digital S.A. de C.V. The Company, based and operating in Mexico, accesses Mexico’s public records provided by 2nd and 3rd sources, including government institutions such as the Supreme Court, Local Courts, Federal Secretariats, and other local and international sources.
USERS FROM THE U.S. – MUST COMPLY WITH FCRA
Before using MEXINTEL, LLC’s website (“The Site”), you must ensure that you have all necessary approvals from anyone whose information you seek and that you comply with all federal, state, and local laws with respect to obtaining, using, and maintaining any information obtained from Mexintel.com (“The Site”). You are responsible for accurately completing an online or physical authorization form, or other release forms requested from the prospected screened individual/corporation, and provide a digital copy of each form to Mexintel, LLC by email.
USERS OBLIGATION
Compliance with Laws / Fair Credit Reporting Act Compliance Certification
You understand and agree that you will use any information obtained through MEXINTEL.com. (the “Site”) in full compliance with all applicable federal, state, and local laws within the United States.
EMPLOYER, CREDIT & LOANS, PROPERTY MANAGEMENT OR LEASING COMPANIES
If you are an employer, credit and loans, property management or leasing company using the Mexintel.com website concerning prospective or current employees for employment purposes, you must comply with the Federal Fair Credit Reporting Act (“FCRA”). By using this website, you certify to Emmobilien Digital S.A. de C.V. (Mexico), Mexintel.com, and Mex Intel, LLC that you will comply with all requirements of the FCRA. The FCRA requires, among other things, prior written authorization from the employee or applicant and certain disclosures to the employee or applicant. For more information on complying with FCRA, please consult your attorney in the U.S. or visit the U.S. Federal Trade Commission’s website.
Before Requesting a Report, You Agree That:
1.- You will make a clear and conspicuous written disclosure to the individual that you are requesting a consumer report about them.
2.- You will obtain written authorization from the individual for the report request.
The information in the report will not be used in violation of any applicable equal employment, Lease opportunity law or regulation.
- If an adverse action (e.g., decision not to hire, promote, retain, or reassign) is based in whole or in part on the report, you will comply with the FCRA, including:
Providing the individual with a copy of the report and a summary of their rights under the FCRA before taking any adverse action.
After taking an adverse action, notifying the individual and providing the required notices under the FCRA.
You will maintain strict confidentiality of the report and implement security procedures to prevent unauthorized access or use.
ADDITIONAL OBLIGATIONS FROM CALIFORNIA USERS
If the individual is a California resident, or you are based in California, or otherwise subject to California law, you agree to comply with the California Investigative Consumer Reporting Agencies Act (CICRA) and other applicable laws, including:
Providing a written disclosure notice containing the specific language required by CICRA.
Obtaining proper written authorization before obtaining the report.
Offering the individual an option to request a copy of the report.
Complying with all adverse action procedures as required by CICRA.
Additional Background Check Requirement for Adverse Employment Decisions
If a background check conducted for employment-related purposes reveals information likely to result in adverse action, you must conduct a county criminal background check in Mexico, where the record was found, to ensure the accuracy and currency of the information. Employers must also consult local, state, and federal laws in Mexico before taking any adverse action against an applicant or employee.
Mexintel.com. MEXINTEL, LLC or Emmobilien Digital S.A. de C.V. will not be liable for any typos, incorrect or incomplete names of individuals or corporations, or other mistakes in any ordering information entered by you.
A checkbox confirming the acceptance of these Terms and Conditions, will be requested in each online transaction or if a wholesaler, signing the acceptance of these Terms and Conditions.
LIMITATION OF LIABILITY/WARRANTIES AND DISCLAIMERS
All services of MEXINTEL, LLC, as well as any information obtained through “The Site,” consist of data from second or third-party information providers, as disclosed in the Legal Framework – Section I. Therefore, there is no guarantee that such information is accurate or up to date, and all information is provided on an “as is” basis.
MEXINTEL, LLC, Mex Intel LLC, and www.mexintel.com do not make any representations or warranties regarding the accuracy, correctness, or completeness of the content or products or services associated with the Site, nor their suitability for any purpose. All materials are provided “as is,” coming directly from the original sources, without any warranty, express or implied. MEXINTEL, LLC specifically disclaims all warranties and conditions of any kind, including implied warranties and conditions of merchantability, fitness for a particular purpose, title, and non-infringement. MEXINTEL, LLC shall not have any liability or responsibility for any errors or omissions in the content of this Site, for your actions or inactions in connection with the Site (including, purchase of products or services through this Site), or for any damage to your computer or data or any other damage you may incur in connection with the Site. Through Mexintel.com, end-user visitors to the “Site” (“Visitors”) can view or execute certain media, text, data, images, graphics, user interfaces, photographs, trademarks, logos, artwork, designs, magnetic translations, digital conversions, software, and other materials posted or made available through the Site (collectively, “Content”) as compiled, distributed, and displayed by Mexintel.com and other second and third-party content providers (“Second / Third-Party Providers”), including but not limited to second/third-party websites or services that provide information about individuals or corporations (each, a “Search Subject”) that can be searched for and accessed through the Site (“Mexintel.com”). You are granted a non-exclusive, non-transferable, revocable, and limited license to access and use the Site, Content, Mexintel.com, and, if you are a Wholesaler client, in accordance with these Terms and Conditions. Mexintel.com may terminate this license at any time for any reason.
MEXINTEL, LLC, www.mexintel.com will not knowingly accept payments from any individual under the age of 18. By requesting information from the Mexintel.com website, you certify that you are an individual who is 18 years of age or older.
CONDUCT
As a condition of using the Mexintel.com website, you expressly agree not to engage in the following activities:
- Use any Search Products or Services to commit identity fraud.
- Harm, harass, intimidate, or infringe upon the rights of another person.
- Impersonate any person or entity.
- Collect, store, or misuse personal data of others.
- Upload, post, email, transmit, or distribute any information obtained from MEXINTEL, LLC. Mexintel.com in a manner that is unlawful, harmful, abusive, threatening, or objectionable.
- Violate any applicable local, state, national, or international laws.
MEXINTEL, LLC. fully cooperates with law enforcement investigations regarding identity theft or any other type of fraud.
UNLAWFUL USE AND RESALE OF SERVICE
By accepting these Terms and Conditions, you agree NOT to copy, duplicate, reproduce, sell, resell, or exploit in any way the service or data obtained from the “Site.”
As a condition of your use of the “Site,” you warrant to MEXINTEL, LLC that you will not use any services of MEXINTEL, LLC, Mexintel, LLC, or www.mexintel.com for any purpose that is unlawful or prohibited by these Terms of Use. If you breach any of these Terms, your authorization to use this service will automatically terminate, and you must immediately cease any use of Mexintel, LLC, or Mexintel.com services, including any materials you may have printed or received.
PROPRIETARY RIGHTS
All proprietary rights to Content, including without limitation Mexintel.com, and any rights in the design, selection, arrangement, compilation, and coordination of such Content, are owned by or licensed to MEXINTEL, LLC and are protected under applicable laws, including but not limited to copyright, trademark, and intellectual property laws. Except as expressly provided in these Terms or with the express written consent of MEXINTEL, LLC, you are not granted any rights or licenses to use any patents, copyrights, trade secrets, rights of publicity, or trademarks of Mexintel or the Content. The “Mexintel” name and logo are trademarks of MEXINTEL, LLC. All other trademarks and logos are the property of their respective owners.
www.mexintel.com reserves all rights not explicitly granted in these Terms and Conditions.
By using the Site, you do not acquire any ownership rights to the Site, Content, or any other information obtained from the Site.
REFUND POLICY
The Service is available for a one-time fee per search.
When using the “Site,” you will be requested to check a box verifying and confirming the name of the corporation or individual when processing your search/order.
Mexintel.com does not provide refunds for its furnished reports in the following situations:
- If you are looking for records in the following states: Puebla, Hidalgo, Tlaxcala, Oaxaca, Nayarit, Tamaulipas, and Michoacán.
- If the criminal record was sealed or occurred before the year 2000.
- Homonymy names.
- If a record was expunged.
- No criminal/civil records were found.
- Customer made a data entry error.
- Customer made a mistake placing an order.
DELIVERY TIME
Our normal delivery time is 24 hrs after signed forms are returned to us. If you do not receive or view the report in your email within 24 hours of processing your order, please call or send a message using our contact form, including your name, account email address, and the type of search and name to be screened as you performed.
We will reprocess and send a copy of the report within the following 4 hours during business days or the next business day if the order was placed on a weekend or outside business hours (M-F 10 AM to 5 PM).
NOTE:
As a record retrieval agency, we incur costs for each search conducted on behalf of our clients and, therefore, offer no refunds for any completed reports. Orders providing search results, with or without criminal/civil/federal/public record data, are considered completed transactions.
